State Agency Adopts Rules for Water Features

On May 1, 2010, the Texas Department of State Health Services (DSHS) adopted its permanent rules for “public interactive water features,” or “PIWFs.”  A PIWF is a water spray, dancing water jet, waterfall, dumping bucket, or shooting water cannon that is designed for the purposes of wetting persons playing in the spray streams.

After DSHS first began contemplating new rules for PIWFs in September, THLA sent several email notices to operators indicating new rules were being drafted.  In response to feedback we received from members, THLA, along with a wide array of industry trade groups and waterpark operators, submitted formal commentary to the DSHS in January.  After considering this commentary, DSHS published their final rules, which directly and immediately affect how PIWF operators test, disinfect, and treat water.  If you operate a PWIF at your property, it is important to employ a certified pool operator or consultant to ensure you are in compliance with these and all other state regulations.
