In past issues of the Industry Update, we reported OSHA is increasing the number of inspections on businesses across the U.S., including lodging properties.  As part of this inspection process, OSHA inspectors are asking to review the property’s policies regarding the prevention of workplace violence.  Under the OSHA law, employers must provide their employees with a safe and healthful workplace.  This safe workplace requirement has been interpreted by many courts to include protecting employees from violence.  The OSHA law also prohibits employers from retaliating against employees for exercising their rights under the law (including the right to raise a health and safety concern or report an injury).
